It is the intent of the Legislature to protect the rights of nursing home residents and the security of public funds when a nursing facility is sold or the ownership is transferred. In any billing for services subsequent to the initial billing for such services, the resident, or the resident’s survivor or legal guardian, may elect, at his or her option, to receive a copy of the detailed statement of specific services received and expenses incurred for each such item of service as provided in subsection . A licensee shall keep complete and accurate records of all funds and other effects and property of its residents received by it for safekeeping. Information gathered by a credentialing organization under a quality assurance program is not discoverable from the credentialing organization. This subsection does not limit discovery of, access to, or use of facility records, including those records from which the credentialing organization gathered its information. If the agency, through its receipt of the adverse incident reports prescribed in subsection , or through any investigation, has a reasonable belief that conduct by a staff member or employee of a facility is grounds for disciplinary action by the appropriate regulatory board, the agency shall report this fact to the regulatory board.

A class IV deficiency is a deficiency that the agency determines has the potential for causing no more than a minor negative impact on the resident. Rules developed pursuant to this section shall not restrict the use of shared staffing and shared programming in facilities which are part of retirement communities that provide multiple levels of care and otherwise meet the requirement of law or rule. Receive and disburse state and federal funds for purposes that the state ombudsman has formulated in accordance with the Older Americans Act.

Keep such fiscal records of its operations and conditions as may be necessary to provide information pursuant to this part. The court shall set the compensation of the receiver, which will be considered a necessary expense of a receivership. A payment to the receiver of any sum owing to the facility or its owner shall discharge any obligation to the facility to the extent of the payment.

Reporting Nursing Home Abuse in Florida

An application for a temporary license must be submitted along with the appropriate fee and work experience as a fully licensed nursing home administrator for 2 years within the 5-year period immediately preceding application for a temporary license. In the event of the death of a client, a licensee shall return all refunds, funds, and property held in trust to the client’s personal representative, if one has been appointed at the time the licensee disburses such funds, or, if not, to the client’s spouse or adult next of kin named in a beneficiary designation form provided by the licensee to the client. If the client does not have a spouse or adult next of kin or such person cannot be located, funds due to be returned to the client shall be placed in an interest-bearing account, and all property held in trust by the licensee shall be safeguarded until such time as the funds and property are disbursed pursuant to the Florida Probate Code. The funds shall be kept separate from the funds and property of the licensee and other clients of the facility. If the funds of the deceased client are not disbursed pursuant to the Florida Probate Code within 2 years after the client’s death, the funds shall be deposited in the Health Care Trust Fund administered by the agency. Funds or other property belonging to or due to a client or expendable for the client’s account that are received by a licensee shall be regarded as funds held in trust and shall be kept separate from the funds and property of the licensee and other clients or shall be specifically credited to the client.

Be entitled to reside in the facility for a total of 60 days within a contract year or for a total of 60 days within a calendar year if the contract is for less than 12 months. If a stay exceeds 14 consecutive days, the facility must comply with all assessment and care planning requirements applicable to nursing home residents. Each contract to which this section applies shall contain express provisions specifically setting forth the services and accommodations to be provided by the licensee, the rates or charges therefor, bed reservation and refund policies, and any other matters which the parties deem appropriate. The licensee shall attach to the contract a list of services and supplies available but not covered by the per diem rate of the facility or by Titles XVIII and XIX of the Social Security Act and the standard charge to the resident for each item. The licensee shall provide written notification to each party to the contract of any changes in any attachment thereto, no fewer than 14 days in advance of the effective date of those changes.

The agency may deny a license to an applicant that fails to meet any condition for the provision of hospice care or services imposed by the agency on a certificate of need by final agency action, unless the applicant can demonstrate that good cause exists for the applicant’s failure to meet such condition. For certified nursing assistants, the required 4 hours of training shall be part of the total hours of training required annually. Provides staffing to an assisted living facility for which the nurse registry does not receive fair market value remuneration. A nurse registry must provide notice, in writing, to the agency at the state and area office levels, as required by agency rule, of a proposed change of address for an operational site or the opening of a satellite office. Patients who are capable of self-administering their own medications without assistance shall be encouraged and allowed to do so. Assistance with self-medication by an unlicensed person may occur only upon a documented request by, and the written informed consent of, a patient or the patient’s surrogate, guardian, or attorney in fact. For purposes of this section, self-administered medications include both legend and over-the-counter oral dosage forms, topical dosage forms, and topical ophthalmic, otic, and nasal dosage forms, including solutions, suspensions, sprays, and inhalers. A home health agency shall submit to the agency, with each license renewal application, the number of patients who receive home health services from the home health agency on the day that the license renewal application is filed. Preparing or maintaining fraudulent patient records, such as, but not limited to, charting ahead, recording vital signs or symptoms that were not personally obtained or observed by the home health agency’s staff at the time indicated, borrowing patients or patient records from other home health agencies to pass a survey or inspection, or falsifying signatures. A facility must be licensed and operating for 30 months before it is eligible to apply for the Gold Seal Program.

The position of any member missing three state council meetings within a 1-year period without cause may be declared vacant by the state ombudsman. Assist the ombudsman in eliciting, receiving, responding to, and resolving complaints made by or on behalf of residents. Serving as legal counsel to the representatives of the State Long-Term Care Ombudsman Program in any suit or other legal action that is initiated in connection with the performance of the official duties of the representatives of the State Long-Term Care Ombudsman Program. The state ombudsman shall be appointed by and shall serve at the pleasure of the Secretary of Elderly Affairs. The secretary shall appoint a person who has expertise and experience in the fields of long-term care and advocacy to serve as state ombudsman. “State ombudsman program” means the State Long-Term Care Ombudsman Program operating under the direction of the State Long-Term Care Ombudsman.

A licensee or administrator, or an employee or representative thereof, who is granted power of attorney for a client of the facility shall, on a monthly basis, notify the client in writing of any transaction made on behalf of the client pursuant to this subsection, and a copy of the notification given to the client shall be retained in the client’s file and available for agency inspection. Each clinic engaged in magnetic resonance imaging services must be accredited by a national accrediting organization that is approved by the Centers for Medicare and Medicaid Services for magnetic resonance imaging and advanced diagnostic imaging services within 1 year after licensure. A clinic that is accredited or that is within the original 1-year period after licensure and replaces its core magnetic resonance imaging equipment shall be given 1 year after the date on which the equipment is replaced to attain accreditation. However, a clinic may request a single, 6-month extension if it provides evidence to the agency establishing that, for good cause shown, such clinic cannot be accredited within 1 year after licensure, and that such accreditation will be completed within the 6-month extension. After obtaining accreditation as required by this subsection, each such clinic must maintain accreditation as a condition of renewal of its license.

If you're still unsure what to write in a thank-you note or you want a few more ideas, consider adding a poem. You can use a nursing home appreciation poem in addition to your personal message. Alternatively, a gratitude poem can make the perfect accompaniment. Either way, if you speak from the heart, your words will be perfect. There's no wrong time to send a thank-you note to a caregiver after the death of a parent or loved one. Ideally, you'll send this note in the weeks after your loved one has passed away, but this mourning period can be busy.

Ultimately, your note will be unique to your situation, but the following examples can help you get inspired as you express your appreciation to a caregiver. When a loved one has passed away, it's important to honor those who made their last moments more comfortable. You can show your appreciation with a thank-you not to a caregiver or a thank-you letter to hospice staff. These messages can mean a lot to the people who were there when it really mattered. Our family wants to take a moment to express our gratitude and appreciation to everyone in our circle of hope.

But it’s not just a nice gesture, it helps make the experience provided by your practice even more special. You see, 82% of patients rank customer service as the most important factor that influences their loyalty to a provider. How can you keep your practice’s local perception positive if unhappy patients will talk to almost double the amount of people about their bad experience? Even if your practice offers the best care within a 30-mile radius, you can’t please everyone. Whether someone is a professional caregiver or is helping out a loved one, they deserve appreciation.

Lesley and Ruth have been especially kind and helpful, as indeed all the members of the nursing and caring staff have been, all of which we do appreciate. The front of this card says it all - there are simply not enough words to express how grateful we are to you all for giving Bertie the best time in his latter years. You were all so kind, affectionate, gentle and understanding - and he flourished. I really believe he lived longer because of the time he spent at Pinewood. She loved to go on the minibus trips with Pat and loved to join in the activities with Lisa, she also very much enjoyed the entertainers that came in. I think the carers are fantastic and worked really hard. Everyone has been very good and I have enjoyed myself very much.

I was impressed by the bedside manners and compassion, something you rarely find these days. Before my mother came to Cobble Hill, I was very nervous and daunted by the fear of past experiences in previous nursing homes. The staff were all so kind and reassuring when she arrived late in the evening last fall, which took away a lot of my apprehension. I hope that you have a great day and enjoy your time off.

We all knew what a difficult time our dad had in his last few days. That’s probably why the soothing effect your presence had on him was quite evident for all to see. Thank you for being a shining light during a difficult period for our family. To all the staff at Pinewood, I would like to thank all of you for enabling my parents to celebrate their 70th wedding anniversary on Tuesday.
